Ibarra Lawsuit is the Pot Calling the Kettle Black

For a good explanation on the weaknesses with Juanito Ibarra's lawsuit against Tito Ortiz, see Todd Martin's piece on MMAPayout.com.  The article explains that to have any real chance of success, Ibarra must prove he is a "private figure" rather than a "public figure."

One factor generally considered in determining whether someone is a public figure is whether he has "access to the media."  This makes sense.  If news outlets are willing to report what someone says, that person has an easier time refuting any false statements made about them.  (I, however, do not have "access to the media."  That's why I have a blog.)

As an example of Ibarra's "access to the media," I found an interview Ibarra gave to a website called ThaFormula.com.  The most interesting thing about the interview is that Ibarra was hardly shy about sharing his own negative opinions of others in the MMA world.   Is Ortiz calling Ibarra a "thief" any more derogatory than Ibarra saying Chuck Liddell was intimidated by Rampage or that Vitor Belfort lacked heart?

Josh Neer Given a Suspended Sentence

Josh Neer has been sentenced for his New Year's Eve escapades.  (See MMAJunkie if you don't recall the specifics.)

Neer pled guilty to OWI (second offense) and Eluding or Attempting to Elude a Police Vehicle. Polk County Iowa District Judge Douglas F. Staskal sentenced Neer to 2 years imprisonment on the first count and 5 years imprisonment on the second count, but the sentence was suspended.  If Neer fulfills the terms of his probation, he will not have to go to prison.

Fans of "The Dentist" got additional good news in that Neer is allowed to leave Iowa  for job-related events including fights, training, and promotional appearances.  This should allow Neer's fight with Kurt "Batman" Pellegrino to go forward.

Neer's fight with Pellegrino is currently slated to appear on the televised Pay Per View portion of UFC 101 on August 8, 2009.  As discussed at MMAFrenzy, the fight was originally supposed to headline Ultimate Fight Night 19 but was moved when that event was postponed to September 16, 2009.   UFN 19 will serve as the lead-in to the hotly anticipated season premiere of The Ultimate Fighter 10,  featuring Kimbo Slice and Roy Nelson.  Although UFN 19 and TUF 10 should do huge ratings, Neer is likely quite pleased just to be able to fight out of state.

Welcome to the Mixed Martial Arts Law Blog

I created this blog to combine two of my main passions (Law and Mixed Martial Arts) and to justify the time I spent earning a journalism degree prior to law school.

My hope is that this site will eventually serve as a clearinghouse for all things related to MMA law, whether it is a story about the many fights that take place in a courtroom instead of a cage or a list of the various state athletic commissions that regulate MMA competitions. If you have an idea for an article or a link that could be useful to MMA promoters, fighters, and/or fans, please email me.

The fight photo at the top of the blog features T.J. "The Spider" O'Brien applying his signature triangle choke on Chris "The Religion" Perez Van Dam.  O'Brien is the former featherweight champion for the Midwest Cage Championship.  Perez Van Dam is one of the toughest fighters I've seen and he recently fought for MaxFightsDM. Brad Fuller of KickAssMMA took the photo.   I took the decidedly less interesting photo of the Polk County Courthouse, which is across the street from my office in Des Moines, Iowa.
